To save attorney fees, my ex and I used the same lawyer in our divorce. Did the lawyer commit legal malpractice by representing us both?

When a couple thinks they agree on all issues, it may seem logical to save money and use one attorney to “handle the paperwork.” This is almost uniformly a bad idea and can have potentially disastrous effects.

Most lawyers recognize the possibility of conflicts of interest, a situation in which it is impossible to represent both sides fairly. However, some states allow a lawyer to represent clients with opposing interests if the lawyer has informed both clients of the conflict in writing and the clients have agreed in writing to the dual representation. When an attorney does represent both sides, it may open the door to malpractice claims if you were harmed by the lawyer’s dual representation.

Possibly, but if the injury was very minor, and there was little if any economic loss, no permanent injuries, and you have very little in the way of potential damages, most lawyers will not be too excited with your claim. One major exception. Where a couple thinks they agree on all issues, it may seem logical to save money and use one attorney to “handle paperwork”. This almost uniformly is a very bad idea. Lawyers recognize the possibility of conflict of interest, in which it is impossible to represent both sides fairly. Most lawyers won’t even entertain the idea of doing this.

Using separate lawyers does not have to lead to creating conflict where none existed; it may be invaluable, however, in making it clear that parties have not considered every potential issue, and have disregarded something that may come back to haunt them later.
